1. Agreement to Terms

By accessing or using the Paragon mobile application and related services (collectively, the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

We reserve the right to modify these terms at any time. Your continued use of the Service following any changes constitutes acceptance of those changes.

2. User Accounts

To access certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

  • You must be at least 13 years old to create an account
  • You must provide accurate and complete information during registration
  • You are responsible for keeping your password secure
  • You must notify us immediately of any unauthorized account access

3. Subscription and Payments

Paragon offers both free and premium subscription tiers. Premium features require a paid subscription that will be billed on a recurring basis.

  • Subscription fees are charged in advance on a monthly or annual basis
  • You may cancel your subscription at any time through your app store account
  • Refunds are handled according to the policies of Apple App Store or Google Play
  • We reserve the right to modify subscription pricing with reasonable notice

4. AI-Generated Content and Analysis

Paragon uses artificial intelligence to provide physique analysis, workout recommendations, and other fitness-related insights. You acknowledge and agree that:

  • AI analysis is for informational purposes only and does not constitute medical advice
  • Results and scores are estimates and may not reflect precise measurements
  • You should consult healthcare professionals before starting any fitness program
  • We do not guarantee the accuracy of AI-generated recommendations
  • Workout programs are suggestions and should be adapted to your individual capabilities

5. User Content

You retain ownership of any content you submit to the Service, including photos, progress data, and other personal information. By submitting content, you grant us a limited license to:

  • Process and analyze your photos for physique scoring
  • Store your progress data to provide personalized recommendations
  • Use anonymized, aggregated data to improve our AI algorithms
  • Display your content within the app as part of the Service features

You are solely responsible for your content and must not submit anything that violates the rights of others or applicable laws.

6. Contests and Prizes

Paragon may offer transformation contests with cash prizes. Participation in contests is subject to:

  • Eligibility requirements including age and subscription status
  • Submission of authentic, unedited progress photos
  • Compliance with all contest rules and deadlines
  • Verification of identity for prize distribution
  • Acceptance of our decision on contest results, which is final

7. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose
  • Submit false, misleading, or fraudulent information
  • Manipulate or attempt to manipulate physique scores or contest results
  • Interfere with or disrupt the Service or its servers
  • Reverse engineer or attempt to extract source code from the app
  • Create multiple accounts to circumvent restrictions
  • Harass, abuse, or harm other users

8. Termination

We may suspend or terminate your account at our discretion if you violate these terms or engage in conduct that we determine is harmful to other users or the Service. You may delete your account at any time through the app settings.

Upon termination, your right to use the Service will immediately cease. We may retain certain data as required by law or for legitimate business purposes.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

Fitness activities carry inherent risks. You assume full responsibility for any injuries or health issues that may result from following workout recommendations or participating in physical activities.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PARAGON AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with applicable arbitration rules.
